Overview

Christine Viney helps clients by providing litigation and advisory guidance on insurance matters as part of a commercial litigation practice concentrated on energy-related, product liability and professional negligence disputes.

Christine's practice includes litigating insurance matters and providing commercial and regulatory guidance to clients in connection with their insurance concerns. She regularly advises on coverage matters and has litigated claims involving a wide range of policy types, including commercial general liability, errors and omissions, directors' and officers' liability, builder's risk/course of construction, life and disability, property and automobile, and related products including performance and surety bonds. Christine also provides advice on insurance matters in connection with corporate transactions, entity risk management including establishing and managing captive insurers, and regulatory matters. 

Christine has been the instructor for Insurance Law in the Faculty of Law at the University of Calgary for the past eight years. She also brings the industry knowledge she gained through her prior work with a major national property and casualty insurer to the insurance litigation she conducts and the insurance-related advice she provides. 

Christine has litigated diverse energy-related claims, including major pipeline failures, disputes related to contractual arrangements including purchase-and-sale and service agreements and land access agreements and claims alleging negligence in the design, construction and installation of energy facilities and technology infrastructure. On the products liability side, Christine has prosecuted and defended claims involving a broad range of goods and services, including turbines, pipelines, construction projects and medical and other consumer products. In the professional negligence area, she defends engineers, lawyers and physicians and prosecutes claims against engineers, insurance agents/brokers and other professionals. 

In connection with these claims, Christine has appeared at all levels of Court in Alberta, as well as in the Courts of Queen's Bench of Saskatchewan and Manitoba and the Saskatchewan Court of Appeal, and has been involved in a variety of international arbitration proceedings.

Along with teaching Insurance Law, Christine remains actively involved in the University's Trial Advocacy program and is on the executive of the Canadian Bar Association Alberta Insurance Section (South).

Christine received many awards in law school, including the William A. McGillivray Gold Medal.

Kensington Capital Partners and Kensington Private Equity Fund in its acquisition and subsequent amalgamation of Resolute Health Corporation Limited, a leading Canadian healthcare services business specializing in the testing and treatment of obstructive sleep apnea.
Wood Group Mustang (Canada) Inc., in defence of an action commenced by Canadian Natural Resources Limited, in the failure of an underground emulsion pipeline in 2009. Amounts claimed are in excess of $80 million.
BMO Life Assurance Company, in defence of an action by commercial investors seeking to treat life insurance policies as investment vehicles.
ICC and AAA arbitrations concerning contractual and products liability in connection with electricity generation equipment and facilities.
UBG Builders Inc (Re), in defence of a law firm alleged to have been negligent in providing advice regarding deposits paid for condominium purchases.
